Anyone accessing or using our Web site, must agree to be bound by these Terms and Conditions ("Agreement"), whether or not you register or subscribe as a member ("Member"). If you decide to subscribe or to purchase any of our dating or referral services (the "Services"), you are required to read this Agreement carefully and indicate your acceptance of the Terms and Conditions by clicking "I Accept," below.

This Agreement sets forth the legally binding terms of your use of our Web site and your Membership and may be modified by Alumni Planet from time to time, such modifications to be effective upon posting by Alumni Planet on the Web site. This Agreement includes, by reference herein, Alumni Planet's Content Policies and Alumni Planet's Service Fees and Costs posted on the Web site. 1. You must be at least eighteen years old to use this site. By subscribing to this site or purchasing any of the Services we offer, you are warranting and representing that you have the right, authority, and capacity to enter into this Agreement and that you will abide by all of the Terms and Conditions set forth herein. Although we will not knowingly accept memberships or subscriptions from person under the age of eighteen, we cannot guarantee that each Member is at least the required age, and we do not accept responsibility for any content, communication or other use or access of the site by persons under the age of eighteen in violation of this Agreement.
2. You must be a citizen of the United Stated of America, and be residing in the United States of America to use this site. By subscribing to this Web site or the Services, you represent and warrant that you are a citizen of the United States of America and that you reside in the United States.
3. This Web site is for the personal use of individual Members only and may not be used is connection with commercial endeavors. Organizations, corporations, companies, or businesses may not become Members and should NOT use the Services or this Web site for any purpose. Illegal and unauthorized uses of this Web site, including the collecting of usernames or email addresses, will be investigated and appropriate legal action will be taken, including without limitation, civil, criminal and equitable redress.

Alumni Planet is an online internet dating and referral service. In order to improve our Web site and offer you better Services, we also advertise in other mediums like Radio, Television, and print. We reserve the right to use your non-identifying information, such as demographic information, gender, and alumni affiliation, in our marketing and advertising campaigns.

To become a Member of the Web site, you must register and subscribe to one of our online services. If you register and agree to become a Member, you agree to provide accurate, current, and complete information about yourself on our subscription forms. You also agree to amend, update, and maintain information to keep it accurate, current and complete. We reserve the right to terminate your Membership if we discover that you have provided inaccurate, incomplete, or misleading information.

Once you become a Member, you will be asked to select a Username and password. These should only be used by you. It is your responsibility to make sure these remain confidential. You may not transfer or resell your Membership to any third party. You may change your password at any time by going to the "My Account" page and selecting "Update Account Information." You are responsible for any activities that are conducted using your account.

Each Member is responsible for the content submitted to the Web site and their interactions with other Members. Alumni Planet reserves the right to review, regulate, monitor, limit and exclude any content, messages, photos, or profiles (collectively "Content") on its Web site. You are solely responsible for the Content that you transmit or publish and display (hereinafter "post") on the Web site or Service. By posting Content to any public area of the Web site, you automatically grant, and you represent and warrant that you have the authority to grant, Alumni Planet an irrevocable, perpetual, non-exclusive, fully paid worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Alumni Planet reserves the right to review and delete any Content that in the sole opinion of Alumni Planet 1) violates the Terms and Conditions of this Agreement, 2) is offensive or illegal, or 3) violates the rights or threatens the safety of another Member(s). The following is a partial list of things that are prohibited on the Web site. Alumni Planet reserves the right to investigate and take appropriate legal action against anyone who, in its sole discretion, violates this provision.

Prohibited Content includes but is not limited to:

• Racism, bigotry, hatred, or threats against any group, class, or individual.
• Illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.
• Junk mail, spam, 'chain letters', unsolicited mass mailings, or advertisements.
• Information that you know is false, misleading, or untrue.
• Pornographic or sexually explicit material of any kind.
• Material that exploits people under the age of 18 in a sexual or violent manner or solicits personal information from anyone under 18.
• Illegal or unauthorized copy of another person(s) copyrighted work, such as pirated computer programs, music, or links to them.

This Agreement will remain in full force and effect while you use this Web site and or receive Alumni Planet's services. You may terminate your Membership at any time by sending a written request to customercare@alumniplanet.com ( or by going to the "My Account" page and selecting "Cancel my Membership.") You will not be entitled to a refund except as required by law. Following the cancellation of your Membership, you are still bound by the Terms and Conditions of this Agreement which are meant to survive the termination of your Membership, including but not limited to the Limitations of Liability and Marketing Provisions.

Alumni Planet may terminate your Membership at any time for any reason by sending notice of such termination to your email address. If your Membership is terminated as a result of a breach of this Agreement, you will not be entitled to any refund except as required by law.

Alumni Planet is not responsible for any incorrect or inaccurate Content posted on the Web site or in connection with the Service, whether caused by users of the Web site, Members, or by any of the equipment or programming associated with or utilized in the Service. Alumni Planet is not responsible for the conduct, whether online or offline, of any user of the Web site or Member of the Service. Alumni Planet assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. Alumni Planet is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, electronic communications, including injury or damage to hardware resulting from use of the Services or downloading materials in connection with the Services. Under no circumstances will Alumni Planet be responsible for any loss or damage, including but not limited to personal injury or death, resulting from any party's use of the Web site, and Content posted on the Web site, or any interactions between users of the site or Members, whether online or offline.

This Web site and the Services are provided "AS-IS" and Alumni Planet expressly disclaims any implied warranties of fitness for a particular purpose or merchantability. Alumni Planet does not guarantee any specific results or make any promises except those expressly set forth in the Subscription Materials.

Alumni Planet is not responsible or liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including but not limited to lost profits, even if Alumni Planet had been advised of the possibility of such damages. Notwithstanding anything to the contrary, Alumni Planet's liability to you for any cause whatsoever, regardless of the form of the action, will at all times be limited to the price paid by you for your Membership.

You agree to indemnify and hold harmless, Alumni Planet, its subsidiaries, affiliates, officers, agents, and other partners and employees, from any loss, liability, claim or demand, including without limitation reasonable attorney's fees, made by any third party due to or arising out of your use of the Service or the Web site in violation of this Agreement and or arising from a breach of this Agreement and or any breach of your representations or warranties set forth above.

If there is any dispute about or involving your Membership or your use of the Web site or the Service, you agree by using the Web site, that the dispute will be governed by the laws of the State of Nevada without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of Nevada, County of Carson City.

This Agreement, accepted upon use of the Web site and further affirmed upon becoming a Member of the Service, including all materials incorporated by reference, contains the entire agreement between you and Alumni Planet regarding the use of the Web site and or the Service. If any provision of this Agreement is held invalid, the remainder of the Agreement shall continue in full force and effect.
